Oklahoma Polygraph Bill of Rights
In accordance with the Oklahoma Administrative Code ยง560:10-1-12, individuals undergoing a polygraph examination in the State of Oklahoma are guaranteed specific protections to ensure fairness, transparency, and professionalism. These rights include:
A. Voluntary Participation
Polygraph examinations are voluntary unless the examinee is subject to mandatory testing due to employment with a governmental agency that requires it as part of an internal investigation policy.
B. Right to Understand the Nature of the Exam
Examinees have the right to be informed about the purpose and scope of the examination prior to the test.
C. Right to Terminate the Exam
The examinee may end the examination at any point without penalty.
D. Advance Review of All Questions
All questions must be presented in writing and reviewed by the examinee exactly as they will be asked prior to the start of the exam.
E. Opportunity to Explain Responses
Before a final opinion is rendered based on chart analysis, the examinee must be given a reasonable opportunity to explain any physiological responses to relevant questions.
F. Pre-Test Explanation
A comprehensive explanation of the polygraph process and procedures must be provided before testing begins.
G. Minimum Chart Requirement
A minimum of two charts (data recordings) is required before a conclusive opinion can be formed.
H. Restrictions on Question Content
Questions that may be interpreted as sexually explicit or related to religious, racial, labor, or political beliefs are prohibited unless directly relevant to the case under investigation.
I. Right to Know the Results
Examinees may request and are entitled to receive their examination results in a timely manner.
